Legal Alliance Company abolished the ruling on the security action in Supreme Economic Court of Ukraine
In the end of April of this year, local commercial court has issued an unprecedented resolution on the security of the claim, which prohibited the State Registrar to conduct the registration actions relating to the legal person, connected with the exclusion of the member of the company and to conduct in this connection the state registration of a new edition of the Charter of the company; the arrest was imposed on fixed assets, real estate, stocks and corporate rights, belonging to the company.
The mentioned resolution on security of the claim has virtually paralyzed the work of the enterprise.
The Company filed a cassation appeal on the decision of the local commercial court, whereas it was taken with violation and misapplication of the procedural rules, namely: articles 33, 34, 66, 67 of the Commercial Procedural Code of Ukraine.
Legal Alliance Company has attained the abolishment by the Supreme Economic Court of Ukraine of the illegal decision of the local commercial court on security of the claim of, which allowed unlocking the work of a large company in Zaporizhsky region. Legal support of the project was exercised by the senior partner of Legal Alliance Company Ilya Kostin and the lawyer Irina Shlyahovskaya.
